Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the InvisaCare mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

InvisaCare is developed and operated by InvisaCare ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

InvisaCare is a mobile application designed to help users track their clear aligner wear time. The App provides:

  • Time tracking for aligner wear periods
  • Customizable reminders and notifications
  • Statistics and progress analytics
  • Goal setting and streak tracking features

Important: InvisaCare is not a medical device and does not provide medical advice. The App is intended solely as a personal tracking tool. Always follow your orthodontist's or dental professional's instructions regarding aligner wear time and treatment.

3. User Accounts and Eligibility

You must be at least 13 years old to use InvisaCare. If you are under 18, you must have parental or guardian consent to use the App.

You are responsible for maintaining the confidentiality of any data stored on your device and for all activities that occur through your use of the App.

4. Subscription and Payments

InvisaCare offers both free and premium subscription options:

  • Free Plan: Basic tracking features at no cost
  • Premium Plans: Monthly, yearly, or lifetime subscriptions with additional features

All purchases are processed through the Apple App Store. By subscribing, you agree to:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions through your App Store account settings

5. Refund Policy

All purchases are handled through the Apple App Store. Refund requests must be submitted directly to Apple according to their refund policies. We do not have the ability to process refunds directly.

For lifetime purchases, no refunds will be issued after 14 days from the date of purchase, unless required by applicable law.

6. User Data and Privacy

Your privacy is important to us. All tracking data is stored locally on your device and synced via iCloud if enabled. We do not collect, store, or have access to your personal health data on our servers.

7. Intellectual Property

The App, including its design, features, content, and code, is owned by InvisaCare and is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or attempt to extract the source code
  • Use the App for any commercial purpose without our written consent
  • Remove or alter any proprietary notices or labels

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVISACARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or information
  • Personal injury or health issues
  • Dental or orthodontic treatment outcomes
  • Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

10. Medical Disclaimer

InvisaCare is NOT a substitute for professional medical or dental advice. The App:

  • Does not diagnose, treat, or prevent any medical condition
  • Should not be used to make decisions about your orthodontic treatment
  • Is not affiliated with any aligner brand or dental provider

Always consult with your orthodontist or dental professional for advice about your specific treatment plan.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may stop using the App at any time by uninstalling it from your device. Termination does not affect any rights or obligations incurred prior to termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.
